Apple INC. Faces Lawsuit Over Apple iPhone 3G Connectivity to the 3G Networks!

This is isn’t what Apple CEO, Steve Jobs had in mind when he saw his precious Apple iPhone 3G make its International Debut on July 11th 2008. Soon after the launch of this 3G marvel, there came a flood of complaints from disgruntled users about the irregularities and the structural defects that had reared their ugly heads after the purchase of the product. Now, according to Yahoo News, one of Apple iPhone 3G customers has finally taken the company for what they are worth and sued Apple Inc. and has claimed that the iPhone 3G network isn’t what had been advertised and that the advertising campaign of Apple Inc is misleading.

The lawsuit has been filed by an Alabama resident, Jessica Alena Smith who has charged Apple with breach of express and implied warranty and unjust enrichment. Throughout the 10 page complaint filed in the U.S District Court for Northern Alabama, Jessica has termed the device in question as “Defective iPhone 3G” and she is also trying to turn this one person complaint into a class action lawsuit.

As per the lawsuit, “Defendant intended for customers to believe its statements and representations about the Defective iPhone 3Gs, and to trust that the device was ‘twice as fast at half the price. Immediately after purchase, Plaintiff soon noticed that her internet connection, receipt and sending of e-mail, text messages and other data transfers were slower than expected and advertised.”

Some affected consumers have stated that, the iPhone 3G constantly shifts between 3G network and EDGE network while in the idle mode and some have even complained that they have lost reception in the middle of a 3G rich environment, while driving in their cars.

The lawsuit asks that Apple be ordered to repair or replace all defective devices and pay unspecified damages, interest, and attorney’s fees.
